1.1 Your use of the India Tech Group platform (the "Platform") and any India Tech Group products, channels, software, data feeds and services, including the India Tech Group learning player (the "ITG Player") provided to you on or from or through the Platform by India Tech Group (collectively the "Service") is subject to the terms of a legal agreement between you and India Tech Group. "India Tech Group" means India Tech Group Pvt. Ltd., whose principal place of business is at Dehradun, Uttarakhand, India.
1.2 Your legal agreement with India Tech Group is made up of (A) the terms and conditions set out in this document, (B) India Tech Group's Privacy Policy and (C) India Tech Group's Community Guidelines (collectively called the "Terms").
1.3 The Terms form a legally binding agreement between you and India Tech Group in relation to your use of the Service. It is important that you take the time to read them carefully.
2.1 In order to use the Service, you must first agree to the Terms. You may not use the Service if you do not accept the Terms.
2.2 You can accept the Terms by clicking to accept or agree to the Terms where this option is made available to you by India Tech Group in the user interface for any Service.
2.3 You may not use the Service and may not accept the Terms if you are not of legal age to form a binding contract with India Tech Group, or you are a person barred from using the Service under the laws of India or other countries including the country in which you are resident or from which you use the Service.
3.1 India Tech Group reserves the right to make changes to the Terms from time to time, for example to address changes to the law or regulatory changes, or changes to functionality offered through the Service.
3.2 India Tech Group will post a notice of changes to the Terms on its platform. Changes will not apply retroactively and will become effective no sooner than fourteen (14) days after they are posted.
3.3 If you do not agree to the modified terms, you should discontinue your use of the Service. Your continued use of the Service after notification of changes constitutes your acceptance of such changes.
4.1 In order to access some features of the Service, you will need to create an India Tech Group account. When creating your account, you must provide accurate and complete information.
4.2 You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify India Tech Group immediately of any unauthorised use of your account.
4.3 India Tech Group reserves the right to disable any user account at any time, including if you have failed to comply with any of the provisions of these Terms.
5.1 India Tech Group hereby grants you permission to access and use the Service, subject to the following express conditions, and you agree that your failure to adhere to any of these conditions shall constitute a breach of these Terms.
5.2 You agree not to distribute in any medium any part of the Service or the Content without India Tech Group's prior written authorisation. You agree not to alter or modify any part of the Service.
5.3 You agree not to access Content through any technology or means other than the video playback pages of the Service itself, the ITG Player, or such other means as India Tech Group may explicitly designate for this purpose.
6.1 India Tech Group operates a clear copyright policy. As part of this policy, India Tech Group may terminate user access to the Service if a user has been determined to be a repeat infringer.
6.2 If you believe that your work has been copied in a way that constitutes copyright infringement, please provide India Tech Group's copyright agent with the following information: (A) an electronic or physical signature of a person authorised to act on behalf of the owner of the copyright interest; (B) a description of the copyrighted work that you claim has been infringed.
7.1 All course content, video lectures, code samples, and learning materials available through India Tech Group are the intellectual property of India Tech Group or the respective content creators, and are protected by copyright law.
7.2 As a registered user, you are granted a limited, non-exclusive, non-transferable licence to access and view course content for your personal, non-commercial, educational purposes only.
7.3 Any reproduction, redistribution, or resale of course content — in whole or in part — is strictly prohibited and may result in termination of your account and legal action.
8.1 By submitting User Content to India Tech Group, you hereby grant India Tech Group a worldwide, non-exclusive, royalty-free, sublicenseable and transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.
8.2 You also hereby grant each user of the Service a non-exclusive licence to access your User Content through the Service, and to use, reproduce, distribute, display and perform such User Content as permitted through the functionality of the Service and under these Terms.
9.1 Other than User Content, all other content on the Service, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of India Tech Group and protected by Indian and international copyright laws.
9.2 Other than User Content, you may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the content on the Service, in whole or in part, without our prior written consent.
10.1 The Service may contain links to third-party websites that are not owned or controlled by India Tech Group. India Tech Group has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites.
10.2 India Tech Group strongly advises you to read the terms and conditions and privacy policy of any third-party website that you visit. India Tech Group does not endorse or take responsibility for products or services on third-party sites.
11.1 The Terms will continue to apply until terminated by either you or India Tech Group as set out below. If you want to terminate your legal agreement with India Tech Group, you may do so by closing your account and discontinuing your use of the Service.
11.2 India Tech Group may at any time, terminate its legal agreement with you if you have breached any provision of the Terms (or have acted in a manner that clearly shows you do not intend to, or are unable to comply with the provisions of the Terms).
12.1 Nothing in these Terms shall affect any statutory rights that you are always entitled to as a consumer and that you cannot contractually agree to alter or waive.
12.2 The Service is provided "as is" and India Tech Group makes no warranty or representation to you with respect to them. In particular India Tech Group does not represent or warrant to you that your use of the Service will meet your requirements or that the Service will be uninterrupted, timely, secure or free from error.
13.1 India Tech Group's total liability to you for all losses arising under or in relation to these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total amount paid by you to India Tech Group in the twelve (12) months prior to the event giving rise to the claim.
13.2 Nothing in these Terms shall exclude or limit India Tech Group's liability for losses which may not be lawfully excluded or limited by applicable law.
14.1 The Terms constitute the whole legal agreement between you and India Tech Group and govern your use of the Service and completely replace any prior agreements between you and India Tech Group in relation to the Service.
14.2 You agree that if India Tech Group does not exercise or enforce any legal right or remedy which is contained in the Terms (or which India Tech Group has the benefit of under any applicable law), this will not be taken to be a formal waiver of India Tech Group's rights and that those rights or remedies will still be available to India Tech Group.
14.3 These Terms and your relationship with India Tech Group under these Terms shall be governed by the laws of India. You and India Tech Group agree to submit to the exclusive jurisdiction of the courts located within Uttarakhand, India to resolve any legal matter arising from these Terms.
